Lotus Medicare Limited will merely act as a
facilitator, for arranging your surgery and holiday, after mutual
agreement between you and our service partners. We shall work towards
providing you with the most competitive quote, based upon the nature of
the surgery, and the type of holiday you select. The products and
services offered by us, shall be delivered by our partners in the
medical and hospitality industry, in the host country. You are expected
to ask us regarding any clarifications you require, on any aspect of the
planned surgery, or the holiday, prior to accepting any deal offered by
us. Kindly note that there are well documented risks with every surgical
procedure, and there is a likelihood of dissatisfaction and
disappointment in certain cases. Although we endeavor to provide modern
and state of the art medical facilities, in hospitals that maintain a
high standard of hygiene, there are universally accepted potential
complications, associated with every surgery. You will be counseled
about these risks and complications prior to your surgery, and you will
need to give informed written consent, regarding the acceptability of
the same. Lotus Medicare Limited will not be liable for any medical
disputes, associated with complications or dissatisfaction with the
final outcome of surgery. Our liability is limited as a third party
mediator, governed by UK law, in bringing you into contact with the
local service providers, in the country where the proposed surgery is to
take place. Based upon the packages you select, we will provide you with
a quote for travel, transfers, pre and post surgical consultations,
investigations and tours. All our quotations will be valid for a period
of thirty days, following which a fresh quotation can be requested. You
will be required to deposit the full amount in the quotation, prior to
your departure, with Lotus Medicare Limited. A cancellation fee of ten
percent of the total amount quoted, shall apply if you withdraw from the
deal more than two weeks prior to the intended date of the procedure. If
you withdraw less than two weeks before the intended date of the
procedure, a cancellation fee of twenty five percent of the amount in
the quotation shall apply. This is necessary to cover the administrative
costs of arranging your surgery and stay in the host country. The
responsibility for providing reliable, accurate and prompt information,
about your medical condition, rests solely on you. Lotus Medicare
Limited will not accept any responsibility, with respect to any problems
that might arise, out of incorrect or inaccurate information about your
medical condition, being furnished by you.
CONFIDENTIALITY
CLAUSE : Lotus Medicare Limited will apply a strict
confidentiality policy, with respect to any information we collect from
our clients. We will use the information collected, to best serve the
interests of our clients, who will themselves be responsible for the
accuracy of the information provided to us. We are registered with the
UK data protection monitoring agencies, and abide by their guidelines.
DISCLAIMER :
Lotus Medical Tourism is the trading name of Lotus Medicare Limited, and
is a third party facilitator between patients and hospitals. Lotus
Medicare Limited does not itself offer any medical or legal advice, or
any kind of insurance. Clients are expected to take out adequate medical
and travel insurance, before their departure, to cover costs in any
unforeseen circumstances. Medical disputes regarding the nature of the
procedure, or the quality of care provided, shall be dealt with, in
accordance with the local law prevailing in the country, in which the
procedure was done.
FORCE MAJEURE :
If and to the extent that the Company is hindered or prevented by
circumstances not reasonably foreseeable or beyond its reasonable
control from performing any of its obligations under this Agreement then
it shall be relieved of its liability to the Member for failure to
perform such obligations.
